The Federal Trade Commission ("FTC") recently issued regulations mandating that providers of financial services inform clients concerning their policies regarding privacy of client information. At this time, the FTC has taken the position that attorneys who practice in the areas of tax and estate planning are also required to inform clients concerning their privacy policies. Lawyers have been and continue to be bound by strict ethical standards of client confidentiality under the New York State Bar Association Lawyer's Code of Professional Responsibility and provisions of the Internal Revenue Code.
